Abstract

The contractual benefit may be completely distorted in the netting contracts between the two parties to the contract, as a result of the imbalance that occurs in the obligations imposed on both of them, and the obligation intended here is the main or essential obligation, which is considered part of the essence of the contract in itself, and its failure leads to the absence of the benefit completely, whether it is in the stage of formation of the contract or in the stage of its implementation, and therefore this results in effects, and among these effects is the invalidity or termination of the contract according to the circumstances to which the contract is exposed, some of which are included in the Iraqi civil law and the laws in question, and this is what will We show it in this research
